Petition for Divorce
You must have been married for a minimum of one year. You must also have a reason for divorce, which can be unreasonable behaviour, separation, desertion or adultery. The marriage between you and your spouse must be recognized by the law in The UK, and you must meet residency rules and domicile rules.
Divorce Process
The divorce process involves many steps, and the first step is that of petitioning for divorce. At this point in the process, there are many decisions that need to be made by the party who is deciding to petition for divorce. Some examples are:
- Where to petition. For those people who are from overseas, they have to decide where to get divorced – there are many things to take into account, such as where you are legally married, and where your main country of residence is, and which jurisdiction will give you the best financial settlement – this is called Forum Shopping.
- Next you need to decide why you are applying for divorce. You can only get divorced if the marriage can be proved to have ended because of a recognized reason or reason:
Adultery – where your spouse has had sexual intercourse with someone other than you.
Unreasonable behaviour – behaviour that does not make it possible for the petitioner to live with their spouse anymore.
Desertion – this must be for 2 years without a reasonable cause
5 years separation when only one of the parties consents
If one party wants to apply for divorce and the other doesn’t, you have to wait for 5 years before you can do so.
To start a divorce an application form (the ‘petition’) needs to be filled in first.
