Investigation

If no agreement has been reached by the end of the first hearing, the court will give directions as to what should happen next. The court will require a variety of information before they can decide on the matter, and this process can involve a number of steps including at least two:

  1. A time limit will be given to each party in order to prepare statements setting out their case. These statements are then filed with the court. If children are involved,A CAFCASS officer is appointed and copies are served upon the other party.
  2. It is the responsibility of the CAFCASS officer to investigate the case and prepare a report for the court, giving suggestions as to what orders, if any, should be made. The court doesn’t have to follow such suggestions, but they usually do.

There are a number of factors that are taken into account during the investigation process including:

  • The ascertainable feelings and wishes of the children involved.
  • The children’s physical, emotional and educational needs.
  • Change of circumstances, and how this is likely to have an effect on them.
  • The children’s age, sex, background and any characteristics that the court considers relevant.
  • Any harm that the child may have suffered or be at risk of suffering.
  • How capable the parents of the children are of meeting their needs.
