Dissolving the Marriage

The first process is to dissolve the marriage. This process is relatively inexpensive, and is fairly straight forward if not contested. The steps are:

  • Step 1 –Petition for Divorce – The husband or wife applies for a divorce. Grounds for divorce must be stated by the petitioner. They are filing for divorce on the grounds of unreasonable behaviour, separation, desertion or adultery.
  • Step 2 – Acknowledgement of Service – This involves the spouse who has received the petition to acknowledge. They have to choose whether to accept or contest the petition, and whether they admit to, or content the grounds that have been stated, and to say if they pay all or part of the costs agreed to.
  • Step 3 – Obtain Decree Nisi – Once they have acknowledged the petition, the court is then able to issue the decree nisi. In order for the court to make a long term financial order, the decree nisi must be in place. The petitioner is able to ask for a decree absolute 6 weeks after the decree nisi has been pronounced.
  • Step 4 – Obtain Decree Absolute – A marriage is only legally dissolved when the decree absolute has been granted by the court.
