Tips on giving oral evidence in court

  • Always listen carefully to any questions put to you and answer clearly.
  • Remember that the person whom you need to convince is the judge, not the lawyers.
  • Speak slowly: often the other party’ s solicitor and the judge (as well as your solicitor, if instructed) will be taking notes of what you are saying.
  • Avoid becoming heated or emotional in response to the other party’s questions; the judge will want to confine his or her enquiry to the facts.
  • And above all answer the question: neither more nor less.
