Collaborative Law
This process is designed to resolve disputes without going to court. Here at Hylton-Potts we are experts in the techniques, and offer them as a service to our clients.
In the process both sides:
- have lawyers;
- enter into an agreement not to go to court;
- have a duty to do a full and frank disclosure of all financial circumstances.
There is an exchange of information and meetings with everybody trying to work together towards an agreement. Unlike mediation lawyers advise during the process and the advice would be discussed openly at meetings with both sides. This can avoid some of the frustrating delays, with mediation which occur when people need to consult their lawyers.
The emphasis is very much on helping clients find a solution for the best of the family as a whole and that will work for them in future.
