Can my employer dock my pay if I cannot get into work?

Employees have protection against an unauthorised deduction from their wages.

Does the contract state that you do not get paid, if you do cannot get in, due to adverse weather?

It can if the Employer drafts it correctly.

Also another argument is that if an employee is unable to attend work, they have not performed their obligations, and therefore are not entitled to pay.

Another Question: Can my employer force me to take a day off as holiday when I am stranded?

Yes, if reasonable notice is given, not just the day before.

My other half was driving

My other half was driving.  The couple share a car.  Each driver from time to time.  Month later a form arrives requiring the keeper to state who was driving.

They cannot remember despite consulting diaries.  It could have been either of them.

This can result in all charges being dropped.

Using a mobile phone when driving

The Police have to prove that you were holding a mobile ‘phone and performing an ‘interactive communication function’.

That means sending or receiving a voice or written message, or email or going on the Internet.

Dictating notes into a ‘phone using it as a dictaphone is not covered.

The nearest we have had in the UK to as a US class actions have related to the tobacco industry, are not really accepted in English law.

We are pioneers in this area, however, and have joined clients together in what is, effect an a class action to put pressure on for example Local Authorities, Government departments and stubborn big business.

‘I decline to give detailed comment on speculation that I am advising either Ashley Cole or Cheryl Cole, or indeed not both of them, which would not be proper.

What I can say is pet custody battles can be bloody.

Their Chihuahuas Buster and Coco could be subject to a battle, as bitter as for those of the £22,000,000 of assets.

Couples must understand that a pet may seem like a family member. To a court it is just another possession to be divided at divorce.

Be aware that if the animal was yours before the marriage or if you have been the primary carer of the animal during the marriage, you are more likely to be awarded possession.

Tell your lawyer how important your pet is to you, and make sure he or she treats this as a priority.

If you have children, it makes the most sense for the pet to live where the children will live, since they have probably formed an attachment.

Talk to your spouse about the pet and see if you can work something out. You might be able to make a mutually acceptable visitation arrangement.

Avoid separating pets if you have two or more of the same species, as in the Cole case. This could cause depression or anxiety for the dogs.

Show that you are the person best able to care for the animal – you have the time to play with it, exercise it and groom it. If necessary, have your vet testify about your ability to care for the animal.’

Teachers disciplined for sexual misconduct

Teachers facing disciplinary action because of sexual misconduct allegations involving pupils have the right to a lawyer.

The teacher (a man) kissed the boy (15) in a local church. He was dismissed after the boy’s parents read about the kiss in their son’s diary.

The school reported the teacher to the Secretary of State for Schools, who, has the power to ban teachers for life from working with children.

Delivering judgment, Lord Justice Laws said that a lawyer might make a “great deal” of difference to the “flavour and emphasis” of the governors’ conclusions, as well as to any contest over the main facts.

“And if an advocate might have effected such a difference before the governors, then the influence of their conclusions on the final decision making might also have been different.”

Rodney Hylton-Potts said “This is a major breakthrough for all in the caring professions. Hearings are not meant to be overly formal or adversarial but we need to bear in mind what is at stake.”

In these days of safeguarding, the implications on a teacher of malpractice allegations can be profound. They are as a bad as being convicted of a criminal offence in other spheres of work.’
